Care In Recruit Ltd is a recruitment solution company that provides work-finding services to its clients and consultancy to the work-seekers. The Company must gather and process personal data (including sensitive personal data) so that it can efficiently provide these services – in doing so, the Company bears the role of a data controller.
 
You may give your personal information to the Company directly in person, or through email (such as on an application, CV, or via our website), or we may collect them from another source such as a jobs board and third-party referrals.  
 
For the processing of your personal data, the Company must have a legal basis. In order to provide work-finding services and/or information relating to roles pertaining to you, we will only use your personal information in accordance with the terms of the following statement.

Gathering and use of personal data


Our legal basis for the processing of your personal data is our legitimate business interests, although we will also adhere to the contract, legal obligation, and consent when it comes to specific uses of data.

We will rely on the contract under circumstances wherein we have to negotiate or enter into a placement agreement with you or your organization, or any other contract to provide recruitment services to you, or receive services from you or your organisation.

We will solely rely on legal obligation, if we are legally required to hold any/all information on to you to fulfill our legal obligations. 

We will, only in some circumstances, rely on consent for particular uses of your data and we will expressly ask for your consent, if legally required.

Categories of data


Candidate Data – the information we gather may include your personal contact details, CV/Work history, education qualifications, emergency contact details, immigration status and documents to verify your right to work in the UK, salary information, bank details, job preferences, training or education certificates, etc.

Client Data – contact details of personnel within organisations, including names, telephone numbers, and email addresses.

Recipient/s of data


The Company has the right to process your personal data and/or sensitive personal data with the following recipients:

  • Prospective employers and our existing clients
  • Individuals and organisations that possess information regarding your references or application to work with us;
  • Professional associations, regulatory, or law enforcement agencies;
  • Third party service providers that conduct some work on our behalf (including CRM provider, professional advisors, such as, accountants, lawyers, auditors, technical support functions);
  • Third party outsourced IT and data storage providers with whom we have an appropriate processing agreement in place;
  • If the Company merges with or is acquired by another business or company in the future, the new owners of the business will gain access to your personal data;

Data retention


The Company will hold your personal data only for as long as is required. We have to keep different data for different periods of time as per the law.

The Conduct of Employment Agencies and Employment Businesses Regulations 2003, require us to keep the records of work-seeker for at least one year from (a) the date of their creation or (b) after the date on which we last provide them with the work-finding services.

If you exercise your right to deletion, we will hold all information we are legal obligated to do so (such as employment contract data or financial payment), for the period that is required by that legal obligation. 

Your rights as a user


Please be aware of your data protection rights that are as follows:

  • The right to be informed about any/all personal data the Company processes on you;
  • The right of accessing the personal data that the Company processes for you;
  • The right to rectification/correction of your personal data held with the Company;
  • The right to deletion of your personal data in certain circumstances;
  • The right to restrict the processing of your personal data by the Company;
  • The right to data portability under certain circumstances;
  • The right to object to the processing of your personal data by the Company that was based on a public or legitimate interest;
  • The right to not being subjected to automated decision making and profiling; and
  • The right to withdraw consent at any point of time by intimating the Company;
